Allegany Insurance Action Finally Settled The McKean County Democrat, March 14, 1963 A civil action which has been hanging fire for
better than three years has finally been settled. An agreement was reached
in the case of the Port Allegany Borough against the Fidelity and Casualty
Co. of New York, according to Council President Charles Catlin. A check
for $8,500 settled a claim of $8,711.55, which included $5,000, plus attorney
fees. It was received Thursday to bring a close to a dispute which started
in May, 1959, when Carl L. Jones ad his wife of the Crystal Springs Trout
Hatchery of Port Allegany sued the borough for $40,000 damages attributed
the result of cleaning the reservoir. Following a trial in McKean County
Court at Smethport in May 1961, the borough settled with The Jones for
$14,961.55. Not being reimbursed for the amount by insurance carrier,
the borough brought an action against the Fidelity and Casualty Co. for
additional monies they had to pay out. Thursday’s settlement ended
any further court action. Attorneys for the borough were R.T. Mutzabaugh
and son, Richard, of Bradford, and G.H. McCoy, borough solicitor.
